General Terms and Conditions

The following General Terms and Conditions (GTC) are binding for all services and products acquired through the platform returnthis.net. Any terms and conditions from third parties or customers are not recognized by returnthis.net. We reserve the right to change the GTC at any time. In 2023, the parent company QR-Solutions AG was founded, and under it, returnthis.net was registered as a protected trademark.

Offer and Scope of Services
The offers from returnthis.net are non-binding and subject to change, especially regarding price, quantity, delivery time, delivery possibilities, and other ancillary services. By placing an order through the returnthis.net website, the customer accepts a binding offer. Returnthis.net confirms the acceptance and scope of the services to be provided via email to the customers.

Finder’s Fee
The account holder may voluntarily set a finder’s fee per item and thereby commits to paying the specified finder’s fee to the finder of a lost item. This payment is exclusively between the two parties—the account holder (owner of the item) and the finder of the item. Returnthis.net is excluded from any finder’s fee payments and cannot be held liable for them. Returnthis.net does not participate in finder’s fees. Legally, the finder cannot enforce a payment from the account holder because the finder’s fee is voluntarily set by the account holder, creating only an agreement based on good faith and mutual trust between the account holder and the finder. However, the account holder is encouraged to reward the finder, as returning an item should be worthwhile.

Return of an Item
The return of an item can be independently negotiated and agreed upon by the finder and the owner. Returnthis.net's service merely facilitates contact between the account holder and the finder of an item. Email addresses of the parties are protected and routed through returnthis.net. If one party voluntarily discloses their email address or other personal data to the other party, returnthis.net is not responsible for this. The form or content of the communication is beyond the influence of returnthis.net. The legal obligation to return a lost item is mandated by law, and the finder is therefore required to contact the owner.

Abusive Contact
If an account holder feels harassed by contact from a finder, the affected person can contact returnthis.net support, which may, at its discretion, block contact with the finder. In cases of criminal behavior, it is the responsibility of returnthis.net to inform the relevant authorities.

Use of Keychains for Shopping Carts
The returnthis.net keychain is designed to fit most chip slots on shopping carts. Due to a special printing process, the QR code is also protected, and no signs of wear should typically occur. However, improper use may cause scratches, for which returnthis.net assumes no liability and no returns of keychains can be guaranteed. Washing with clothing is also not recommended.

Use of Pin Stickers from returnthis.net
The pin stickers come with a warning inside the packaging stating that the adhesive does not adhere to fabrics, rocky, rubber-like, and rough materials. It is also recommended to clean the carrier material before applying the pin sticker to ensure good adhesion. Returnthis.net assumes no liability for items where the pin sticker has fallen off.

Delivery
Returnthis.net is bound only by written delivery dates. If no delivery dates are agreed upon, delivery will occur within 30 business days. For larger productions for retail customers, the written agreed dates for the delivery of products apply. Changes to orders, unless otherwise agreed, will nullify previously set dates and deadlines. In cases of force majeure or other events not caused by returnthis.net, delivery and performance deadlines will be extended accordingly.

Customer’s Delay in Acceptance
The customer is obligated to take the necessary measures for accepting the goods. If the customer incurs costs due to insufficient arrangements, they will bear these costs themselves. Returnthis.net reserves the right to claim further damages in any case.

Inspection and Notification Obligations
The customer is obligated to inspect delivered products or services immediately upon receipt for defects or deficiencies and to notify returnthis.net in writing of any recognizable defects or deficiencies without delay. Customized products or services are considered accepted if the customer does not raise a written objection within 10 days after the delivery of the goods or service.

Defect Notification
Defects are considered properly notified if warranty claims are made in writing and include a detailed description of the defect.

Right of Return
The customer has the right to return the received goods within 5 days in perfect condition and in the original packaging. The cost of the return is borne by the buyer.

Warranty
Upon receipt of a valid defect notification, returnthis.net will, at its discretion, either provide instructions for rectifying the defect or take other appropriate measures to correct the error (e.g., providing information sheets or instructions). If these measures are not successful according to the previous provisions, returnthis.net can remedy the defects by repair, replacement with faultless goods, or provision of a new product, at the customer's choice. If repair or replacement fails, the customer has the right to a price reduction or cancellation of the contract, which includes a full refund of the purchase price. The warranty claim expires if the customer or third parties have made changes to the delivered products unless the customer can prove that the defect is not due to these changes.

Liability
Returnthis.net excludes all liability for sold and delivered products within the scope of legal provisions.

Prices
The prices according to the order confirmation are binding, plus VAT. Prices are net, meaning excluding freight costs. Deliveries and services for which no explicit prices have been agreed upon in advance will be billed at the list prices valid at the time of service. Services for which no fixed price was agreed upon in advance will be billed at the list prices valid at the time of order acceptance. Unless expressly agreed otherwise, returnthis.net is not bound by the prices if a delivery period of more than two months from the written order confirmation is provided. In this case, the list prices valid at the time of service will be charged. For orders from business customers with larger quantities, VAT will be shown separately.

Payment Terms
Only payments by credit card, PostFinance Debit, or Twint are allowed for shop orders, and the amount will be charged on the day of order receipt. For business customers ordering larger quantities, invoicing is of course also permitted. The payment term can be determined according to the contract clause but may not exceed 30 days.

Assignment of Claims
The customer is not authorized to transfer their claims against returnthis.net in whole or in part to third parties without the consent of returnthis.net or to assign rights and/or obligations from contracts concluded with returnthis.net. This particularly applies to warranty claims.

Severability Clause
Should individual provisions of these GTC be wholly or partially ineffective, unenforceable, or later void, or lose their legal effectiveness or enforceability, the validity of the remaining provisions of these GTC shall not be affected. Instead of the ineffective, unenforceable, or void provisions, a regulation shall apply that comes as close as possible to the economic purpose of the ineffective provision.

Governing Law and Jurisdiction
All contracts concluded via returnthis.net are subject to Swiss law. The place of performance and exclusive jurisdiction for all deliveries and services is the respective location of returnthis.net. Returnthis.net is a registered trademark of QR Solutions AG in Bern.
